Contract Terms
By using this site you, heretofore referred to as “user”, agree to be bound by the terms contained in the Terms of Use and Privacy Statement. The following documents form a legal agreement between the user and Starlight Entertainment. By using this site you acknowledge you have viewed this document and understand and agree to the terms outlined in it.  You further agree to be bound by any laws and regulations governing the use of this type of site.  If you do not agree to these terms please discontinue use of this site.

Restrictions of use for copyrighted, trademarked, and Intellectual Property
The information on this site, including but not limited to: photos, video, product descriptions, and website code is protected by United States Copyright Law.  Copying or distributing any portion of this site or information on this site is prohibited without written consent from Starlight Entertainment.  Portions of our site contain documents that are intended to be downloaded for your use.  The documents may or may not have originated from Starlight Entertainment therefore Starlight Entertainment will not be held liable for any “misinformation” that might be contained in these documents.  Additionally the use of these documents is intended for personal, non-commercial use only. 

The trademarks displayed on this site, both registered and unregistered, are property of Starlight Entertainment and its respective vendors.  Any use of a trademark found on this site is prohibited unless authorized in writing by Starlight Entertainment. 

Under no circumstances, including but not limited to negligence, will Starlight Entertainment, its ownership, management, employees, or third party associates be held liable for the any type of damages including but not limited to direct, indirect, incidental, accidental or consequential damages, including but not limited to harm to personal or professional equipment and/or personal injury or death resulting from the use of this site, products sold on this site, or any product sold by Starlight Entertainment.  It is your responsibility to read all documentation and register, if applicable, any product you purchase with the manufacturer so that you may be advised by them of any potential problems or dangers possibly resulting from the use of a product.  Under no circumstance will Starlight Entertainment be liable for: including but not limited to, the cost of repair, cost of transportation to and/or from repair facility, or any loss or costs arising from the product being inoperable or unusable.

Truss Products 
Special care should be taken when using truss products.  Starlight Entertainment LLC makes no claims as to the structural capacities of any truss system or component we sell. Any loading data supplied originated from the fabricator and is intended for guidance purposes only. Determining suitability of these products for their intended use is the responsibility of the client. It is strongly recommended that certified professional riggers and licensed structural engineers be consulted when using truss products. Client agrees to indemnify and hold harmless Starlight Entertainment LLC of and from any and all, inclusive of third party, claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys’ fees and costs that may result from the use of these products. It is the responsibility of the end user to comply with any and all federal, state, or local regulations governing the use of the products we sell.  Any drawings supplied are for informational purposes only and do not serve as an endorsement for use of the truss in that configuration.

Typographical Errors
There is a large amount of information contained on our site.  Although we attempt to keep that information current and correct Starlight Entertainment reserves the right to refuse any order for any reason including due to incorrect pricing or typographical errors on our site. If you place an order online we will notify you of the incorrect price or typographical error, at which time you can decide to cancel the order or accept a revised order with the corrected price or information.  Although we normally don’t charge a credit card until the order is ready to be shipped, if your card has already been charged we will promptly refund your card if you decide to cancel or refund the original incorrect amount and recharge to proper amount.

Not every product on our site is available for shipment 100% of the time.  Some items are stocked at our location while others are stocked in the warehouses of our suppliers.  For this reason it is possible that the items you order may not be available for immediate shipment.  If an order you place has an item or items that is/are not in stock at time of order Starlight Entertainment will contact you and notify you of the expected in stock date before shipping any part of your order.  At this time you may choose to cancel the order or place the out of stock item(s) on backorder for shipment at a later date. In stock items will ship immediately.  If you decide to proceed with your order we will charge it in its entirety unless you specifically request otherwise.   We reserve the right to refuse or cancel your order at any time for any reason. 

Sales Taxes
Starlight Entertainment collects sales tax for orders placed in Oklahoma, Kansas, California and Pennsylvania or shipped to an address in these states.  The sales tax landscape is changing due to the Wayfair decision. We may have to charge sales taxes or report to state authorities certain details about your transaction. Although we don’t typically collect sales tax for orders shipped to other states there are instances in which we will have to charge an additional fee to cover sales taxes imposed on us as a result of your order.  You will be notified of any such charge before finalizing your order with us.  For orders in which no sales taxes are collected by Starlight Entertainment, each customer shall be completely and solely responsible for any and all applicable taxes, be it sales or otherwise, levied by any governing body.

As you may have noticed we offer many items on our site with free ground shipping.  Ground shipping methods may require additional time before your order is shipped than other, more expedited methods.  This extra time will normally not be more than 48hrs. This is a great way to save a few extra dollars if you don’t require your products be shipped right away.  There are some items on our site that will have a shipping charge.  Again this charge is for ground shipping only.  In order to better serve you we will only accept orders with expedited shipping over the phone.  Every attempt will be made to ship your products so they arrive when you expect them to.  In the event of a problem, including but not limited to: mis-ship, carrier error, incorrect shipping information, or late or non-shipment, Starlight Entertainment will not be held responsible for any expense as a result of the error.  Shipping charges will not be adjusted or refunded for any reason.  As stated previously, every effort will be made to ship your products so they arrive when needed.  

Any information, reviews, comments, ideas, etc. posted or transmitted on our site is considered public and may be used in a manner that makes it public.  We reserve the right to screen and add or remove any information on our site submitted by a user (i.e. review information).  Any material that we deem inappropriate or not useful to us or our clients will be removed.  We prohibit and will remove any information that is, including but not limited to, defamatory, obscene, inflammatory, pornographic, profane or otherwise not useful or germane to our website.  Starlight Entertainment will remove all known information that could give rise to civil or criminal liability.  Basically it is our site and we’ll determine what is published on it!

Children's Online Privacy Protection Policy
Starlight Entertainment will make every effort to preserve the online privacy of all of our users and that includes children.  We will not knowingly collect any personal information from a child under the age of 13.  It is likely that nobody even reads this especially if you are 13 or under but if you are reading this and under the age 14 you need to ask your parents to assist you in using our website.  Although it is likely that you know how to use the internet better than your parents.  But we digress…Starlight Entertainment sells products that are to be used by adults and by making a purchase from Starlight Entertainment you are representing yourself as such.

Choice of Law
Our goal is to have you completely satisfied with every aspect of your transaction with us.  Starlight Entertainment will in good faith try to settle any dispute that arises to mutual satisfaction.  If mutual satisfaction cannot be attained any dispute, controversy or claim relating to the use of this site or any dealings with Starlight Entertainment shall be finally negotiated, disputed and settled by a professional arbitrator and held in accordance with the Commercial Dispute Resolution Rules as set by the American Arbitration Association.  Arbitration shall take place in Payne County Oklahoma and any applicable laws of the state of Oklahoma shall apply. The decision of the arbitrator shall be final, conclusive and binding on the parties to the arbitration. Each party shall pay their own respective attorneys’ fees.  Additional expenses resulting from arbitration shall be equally split amongst the parties involved.  These expenses will be strictly limited to fees charged by the arbitrator and expenses in which all parties receive equal benefit or use.  No travel, lodging, or other expenses of any nature shall be shared. If the arbitrator discovers that the dispute and resulting arbitration was brought or defended in bad faith, without merit or without a reasonable basis in fact, the non-prevailing party shall pay all attorneys’ fees and expenses and all costs and expenses of the arbitration.  Starlight Entertainment will not be a party to any dispute stemming from a defective product, warranty issues, or issues in which Starlight Entertainment had no control over settling the dispute.  You will be made aware of any third party involvement with any transaction (i.e. subcontractor for install).  If a dispute arises that is a result of that third party Starlight Entertainment will have no involvement in the settlement of that dispute except where required by law.    

Payments by major credit card (Visa, Master Card, American Express, Discover), money order, wire transfer, cashier’s check, corporate check, personal check and cash are all gladly accepted.  When possible we will also allow payment by PayPal.   Payments by check and money order will require ample time (up to 2 weeks) to clear the bank.  Credit card orders will be shipped to a billing address or authorized shipping address on file with your credit card company.  We may ask for the issuing bank name and telephone number to verify address information.  This is done for your protection as well as ours.  Starlight Entertainment uses security encryption technology, secure, professionally managed third party servers, and well known payment processors (namely PayPal and Google Checkout) for payment processing.  Orders placed online will route to the named processors for the final payment information and we will not have access to your credit card data.  If you prefer speaking with a real person by placing your order over the phone we welcome and actually prefer this method of doing business. We thoroughly investigate the validity of each credit card. We will assist the authorities in prosecuting all fraudulent transactions. This validation process can sometimes take several days if there is an issue with the card supplied by you.  We normally process transactions at the end of each business day.  If there is an issue with your card your order will be held from shipment even if it is a time sensitive order.  We will attempt to process your card only once a day with a maximum of three attempts.  Please keep in mind this is for your protection as well as ours.

Revisions to Terms of Use
Starlight Entertainment may change at any time and without notice these Terms of Use.  By using this site you are bound by these Terms of Use so it is your responsibility to check this page before ordering and check it frequently.

General Information/Policies
Starlight Entertainment works hard to get orders “out the door” and into your hands quickly.  Although not guaranteed, most orders placed before 12:00PM will ship the same day or the following day.  Some products from certain manufacturers may take longer.  We will advise you of the expected ship date and expected delivery date at time of order. Some items on our site may not be in stock at the time of order.   If this happens we will advise you of the expected in stock date.  At this time you can choose to leave the item(s) on back order and the remaining items on your order will ship or will have shipped.  We will typically charge the entire order unless specifically instructed otherwise.  Please make us aware of any time sensitive orders and we will make every effort reasonable to get your product(s) to you on time but we cannot guarantee delivery.  To ensure proper care of your order any expedited orders will need to be placed over the phone with one of our sales representatives by calling 1-800-793-5308.  As you will notice most products on our site offer free shipping.  Those products without free shipping are charged a reasonable shipping charge.  Either way we only offer ground shipping services for orders placed on our site.

Returns and Exchanges
For the purposes of our Terms of Use statement there are no returns allowed. This policy over-rules any other representation, verbal or written, of a return policy.  We offer a wealth of information on our website and are available by phone to answer any questions you might have.  At managements sole discretion Starlight Entertainment may allow some items to be returned for store credit.  In these cases a restock fee will be charged, typically between 15%-30%.  Shipping charges will not be credited for any reason.  Any approved return must include a return authorization # (RA) that will be supplied by Starlight Entertainment. Returned items will need to be in original packaging with all original documentation, and in new, unused condition meaning no scratches, scuffs, wear, etc.  Most items we ship will be double boxed.  Any items returned are expected to be double boxed regardless of how it was originally shipped.  Starlight Entertainment will accept no COD shipments, all returns will need to be shipped prepaid.  Any warranty issues will be handled by the manufacturer of the product as Starlight Entertainment does not offer any warranty for the products we sell.  Please give us a call at 1-800-793-5308 and we’ll provide you with the appropriate contact information for the manufacturer of your product.  Any item found defective upon arrival will be repaired under warranty by the manufacturer or replaced by Starlight Entertainment.  Starlight Entertainment’s management will determine the best course of action.

Some products may be offered with free or discounted shipping.  If the situation arises and we grant a return request you will be credited in the form of a store credit the full amount less any restock fee and the full original shipping costs.  These store credits are available for use on any in stock non-sale item.

Free Shipping
Our free shipping offer is only good for UPS ground shipments within the contiguous 48 United States (excluding Alaska and Hawaii).  Items which are oversized and heavier items will not qualify for free shipping.  This may or may not be reflected in the total price you get from our online ordering system.  Any additional handling or shipping charges will be presented to you for approval before shipping.  Additional shipping charges may be processed in a second charge to your credit card.  Again, we will get you approval prior to any additional charges to your card.  Please contact Starlight Entertainment for more detail about shipping costs and delivery times.

Products Offered
Unless specifically stated otherwise we sell only new factory sealed products.  These products carry a warranty from the manufacturer. At this time Starlight Entertainment does not offer any warranties of any type.   For warranty information on a specific product please contact us.  If you have a product that needs warranty service please contact the manufacturer directly or feel free to contact us and we’ll provide you with the information you need.  From time to time we may have special opportunities to sell factory refurbished and b-stock items.  These items will be noted as such and any special terms or conditions will be noted as well. Starlight Entertainment is not an authorized dealer for all of the brands we sell. Please check with all manufacturers for warranty information as some restrictions may apply. All information including brand names, logos, pictures, or other information are the property of their respective manufacturers or copyright holders. 

Price Matching
Starlight Entertainment will price match on a case to case basis.  We follow all manufacturers policies regarding MAP (minimum advertised price).  We believe excellent customer service counts for a lot and should be factored into any purchasing decision.  However, we understand that price is a major factor in decided who to purchase from.  If you feel our price is too high on a product please feel free to make us an offer.  The worst thing that can happen is that we say no.  Any special pricing will be given only over the phone, no written quotes will be given.
